Quotes or Estimates

It is the Purchaser's responsibility to review takeoffs and estimates provided by Jay's Metal Ltd. for its accuracy. Jay's Metal Products will not be held responsible for any missing information or incorrect measurements once the order has been placed.

Application of Terms and Conditions of Sale

Terms and conditions of a sale shall apply to any quote, purchase order, order acknowledgement, invoice, and any other document used to place an order. If these terms and conditions are accepted by both parties, the Agreement represents a contract between both parties with respect to the Goods. If there is a conflict or inconsistency between these Terms and any other part of the Order, these Terms shall supersede. No additional or differing terms communicated by the Purchaser shall be binding. Any purchase order or supporting documents sent by the Purchaser to Jay's Metal Ltd. shall be used for internal purposes only and will constitute as part of the Agreement between both parties when any order is placed.

Color Match

Colors shown on the website are representative of the actual colours but are limited by printing conditions. Actual pre-painted metal samples are available upon request. In order to avoid mixing colour batches on projects, we recommend you discuss with our team the size and the number of phases, so we can ensure Jay's has enough of the same material to complete the project. If any additional product is added after the initial order is completed, a colour match cannot be guaranteed.

Cutlist

Jay's Metal takes every precaution and effort to ensure that all panels are manufactured to the specified cut list. Actual panel size may have a +/-⅛” tolerance for width and a +/-⅛” tolerance for length. Due to tolerance in width and length, Jay's Metal strongly recommends that physical samples and measurements are taken prior to fabrication. The Purchaser acknowledges that image dimensions on the website may vary from the actual product due to the gauge of the metal.

Cancellations

Orders may not be cancelled once production has commenced.

Late Payment

Late payments are subject to a 3% monthly interest. After 45 days your account will be forwarded to a collection agency. The purchaser is responsible for monthly interest, 50% agency fee the balance owing and any other legal costs.

Crate

Jay's Metal offers both standard and custom crating options. All custom crate requests must be submitted in writing to the vendor prior to approval for production. Custom crates are subject to additional cost. If a custom crate is not requested, we will proceed with the standard crate. See pictures for reference.

Pick-up & Delivery

Jay's Metal Products Ltd visually inspects all purchase orders prior to pick up. We strongly recommend that you ensure all quantities, angles and dimensions are correct prior to loading/leaving Jay's Metal facility. Any discrepancies in the product must be reported within 24 hours with proof of damage. Jay's Metal Products Ltd is not responsible or liable for damage caused by incorrect loading, strapping, or movement during transport.

Any third party pick up is responsible for all good's once they are loaded. Jay's Metal will not be liable for any damage and/or loss caused by third party delivery services.

Returns

Custom items are non-returnable.

Warranty

Jay's Metal Products Ltd warranty is available to see on our website at www.jaysmetal.com/warranty. All warranty forms must be completed within and returned to Jay's Metal Product's Ltd within 30 days of the purchase order being placed. Jay's Metal will not uphold any customer warranty with an unpaid or overdue account balance.

Change of Terms

Jay's Metal Products Ltd may change this Agreement as allowed by applicable law without notice. This may include changing, adding, or removing terms. Applicable changes may be in response to legal, business, competitive environment or other reasons not listed here.

OIL-CANNING : Vivo 300 & Icon Panel Systems

Oil-canning is known as a phenomenon when there is visible waviness in the flat areas of metal or roof systems and typically occurs during installation.

It is important to note that by choosing a thicker gauge material, adding a stiffening rib to the panel, following the recommended screw pattern and depth installation guidelines and proper substructure alignment, it may help reduce or eliminate the appearance of oil-canning.

The severity of the waviness will vary due several components, which may include framing when out more than 1/4”, the length of the panel if greater than 24’, the color, finish, time of day, time of year, the angle the metal is viewed from, perforations and screw tightness. Further, each guage has different bending characteristics which may cause a slight concave or convex appearance.

As a result of the potential risk of panel deformation as described above, I hereby acknowledge that I have read and understand the information provided in this document and waive Jay’s Metal Products Ltd. from any responsibility/liability for any oil-canning that may occur during and after the installation of the panels.
